settles $25.5 million illegal strip-search case.
ADR Services, Inc. neutral Eugene Moscovitch, Esq. settled a $25.5
million illegal strip-search case last September.
As many as 160,000 inmates sued the County of San Bernardino's Sheriff's
Department in U.S. District Court for being subjected to illegal jailhouse
strip searches during a five year period. These illegal strip-searches were
allegedly done by jailers and sometimes done in front of inmates and
deputies of the opposite sex.
When the time came to discuss settlement and enter into mediation, both the
San Bernardino County's Board of Supervisors and Southern California's top
civil rights lawyers turned to Gene Moscovitch for assistance.
Gene is a former deputy federal public defender and a mediator of numerous
cases involving claims of excessive force, failure to protect, and
deliberate indifference to inmates medical and psychological needs.
Over the course of a three day mediation, Gene Moscovitch worked directly
with two national insurance carriers, over 20 lawyers, and many high ranking
public officials, all with divergent political beliefs and agendas. In the
end, Gene was able to assist the parties in reaching a $25.5 million dollar
settlement that is now a matter of public record. In fact, the settlement is
one of the largest payouts in a jailhouse strip-search case.

Justice Laurence Kay settles $96 million Smokeless Tobacco claim.
ADR Services, Inc. neutral Justice Laurence Kay was featured on the front
page of The Recorder in October of 2007 for mediating the $96
million cash settlement of the litigation known simply as the
Smokeless Tobacco Cases, 02-004250. The California class action
antitrust litigation involved claims of anti-competitive practices and
anti-trust violations.
The Smokeless Tobacco Cases found their origin in Kentucky when allegations
of monopolistic business practices by United Smokeless Tobacco (UST) came to
light upon the filing of a federal Sherman Act suit. A competitor, Conwood
Sales, Co., accused UST of underhanded business practices, including the use
of exclusive vending agreements with retailers and the destruction of
competitors' point-of-sale displays.
These suits gained real momentum when in 2000, a federal jury in Kentucky
ordered United Smokeless Tobacco to pay treble damages to Conwood totaling
$1.05 billion and that verdict was later help up on appeal.
Justice Kay helped the parties to reach consensus with only three months
left before trial. The settlement resolved claims that US Tobacco engaged in
"extensive restrictive and exclusionary acts" to eliminate competition for
moist snuff. It is the only class action in which United Smokeless
Tobacco has agreed to pay cash to consumers instead of coupons.
Hon. Laurence Kay is the former presiding justice on the First District
Court of Appeal in California, Division 4. He has been a full time neutral
since 2005, when he retired from the bench. He has been exclusive with ADR
Services, Inc. since his retirement and is considered to be one of their
premiere neutrals in Northern California.
